{"id":18609,"date":"2026-02-14T07:44:54","date_gmt":"2026-02-14T12:44:54","guid":{"rendered":"https:\/\/amautaenlinea.com\/blog\/?p=18609"},"modified":"2026-02-14T07:54:18","modified_gmt":"2026-02-14T12:54:18","slug":"gobierno-mef-prepara-mecanismos-legales-para-frenar-leyes-ya-aprobadas-que-crean-gasto-sin-financiamiento-lo-ultimo","status":"publish","type":"post","link":"https:\/\/amautaenlinea.com\/blog\/gobierno-mef-prepara-mecanismos-legales-para-frenar-leyes-ya-aprobadas-que-crean-gasto-sin-financiamiento-lo-ultimo\/","title":{"rendered":"Gobierno: MEF prepara mecanismos legales para frenar leyes ya aprobadas que crean gasto sin financiamiento \u00a1LO \u00daLTIMO!"},"content":{"rendered":"<p data-start=\"380\" data-end=\"587\"><strong data-start=\"380\" data-end=\"464\">Si una norma crea gasto permanente, debe tener \u201cfuentes de ingresos permanentes\u201d<\/strong>; si no las tiene, <strong data-start=\"483\" data-end=\"531\">puede volverse \u201cno aplicable\u201d en la pr\u00e1ctica<\/strong>, aunque ya exista la ley y la gente reclame el derecho.<\/p>\n<p data-start=\"590\" data-end=\"841\">Por eso el Ejecutivo habla de <strong data-start=\"620\" data-end=\"690\">una \u201cacci\u00f3n de constitucionalidad\u201d ante el Tribunal Constitucional<\/strong> y, adem\u00e1s, de <strong data-start=\"705\" data-end=\"745\">buscar f\u00f3rmulas para hacer graduales<\/strong> ciertas medidas para que entren dentro de la caja fiscal. Esto encaja con la frase que se le atribuye en varias notas: \u201clas leyes no crean dinero\u201d.<\/p>\n<h2 data-start=\"936\" data-end=\"979\">\u00bfLa CTS 100% para docentes nombrados corre riesgo?<\/h2>\n<p data-start=\"980\" data-end=\"1372\"><strong data-start=\"980\" data-end=\"1023\">Legalmente, hoy existe y est\u00e1 regulada.<\/strong> La <strong data-start=\"1027\" data-end=\"1040\">Ley 31451<\/strong> establece que la CTS del profesor se otorga \u201cal momento de su cese\u201d a raz\u00f3n del <strong data-start=\"1121\" data-end=\"1172\">100% de la Remuneraci\u00f3n \u00cdntegra Mensual por a\u00f1o<\/strong> (o fracci\u00f3n mayor a 6 meses), y adem\u00e1s fija una <strong data-start=\"1221\" data-end=\"1250\">implementaci\u00f3n progresiva<\/strong> seg\u00fan el a\u00f1o de cese: 2022 (50\/20\/30), 2023 (70\/30) y <strong data-start=\"1305\" data-end=\"1333\">desde 2024: 100% al cese<\/strong>.<\/p>\n<p data-start=\"1374\" data-end=\"1455\"><strong data-start=\"1374\" data-end=\"1407\">\u00bfD\u00f3nde est\u00e1 el \u201criesgo\u201d real?<\/strong> M\u00e1s que perder el derecho, el riesgo suele ser:<\/p>\n<p data-start=\"1458\" data-end=\"1681\"><strong data-start=\"1458\" data-end=\"1492\">Demoras\/complicaciones de pago<\/strong> (gesti\u00f3n regional, tr\u00e1mites, flujo de recursos). Por ejemplo, hay reportes de protestas por <strong data-start=\"1585\" data-end=\"1611\">falta de pago efectivo<\/strong> pese a transferencias para CTS.<\/p>\n<p><strong data-start=\"1683\" data-end=\"1707\">Conclusi\u00f3n CTS 100%:<\/strong> con la informaci\u00f3n disponible, <strong data-start=\"1739\" data-end=\"1767\">no es que est\u00e9 \u201canulada\u201d<\/strong>, pero <strong data-start=\"1774\" data-end=\"1809\">s\u00ed puede haber riesgo operativo<\/strong> (cu\u00e1ndo y c\u00f3mo se paga) y, en el discurso del MEF, existe la idea de <strong data-start=\"1879\" data-end=\"1899\">volver \u201cgradual\u201d<\/strong> lo que no fue financiado correctamente.<\/p>\n<h2>\u00bfLa Ley <strong data-start=\"2590\" data-end=\"2664\">100% CTS para docentes contratados y auxiliares?<\/strong><\/h2>\n<p><strong data-start=\"2590\" data-end=\"2664\">Ley N.\u00b0 31552 (2022) \u2013 100% CTS para docentes contratados y auxiliares<\/strong><br data-start=\"2664\" data-end=\"2667\" \/>La CTS al <strong data-start=\"2677\" data-end=\"2685\">100%<\/strong> de la remuneraci\u00f3n (seg\u00fan el v\u00ednculo) y se\u00f1ala implementaci\u00f3n progresiva. <strong data-start=\"2800\" data-end=\"2811\">Riesgo:<\/strong> similar al de la 31451: no es que \u201cse caiga ma\u00f1ana\u201d por s\u00ed sola, pero al implicar gasto puede entrar en el radar cuando el MEF habla de \u201cnormas sin financiamiento\u201d.<\/p>\n<h2 data-start=\"3659\" data-end=\"3726\">Pensi\u00f3n de\u00a0 3300 para docentes cesantes y jubilados<\/h2>\n<h3 data-start=\"3659\" data-end=\"3726\">\u201cRiesgo\u201d por no estar consolidada como ley vigente (pensi\u00f3n)<\/h3>\n<p data-start=\"3727\" data-end=\"4051\"><strong data-start=\"3727\" data-end=\"3828\">Aut\u00f3grafa \/ propuesta para elevar pensiones de docentes cesantes y jubilados (monto tipo S\/ 3300)<\/strong><br data-start=\"3828\" data-end=\"3831\" \/>Aqu\u00ed el riesgo es distinto: <strong data-start=\"3859\" data-end=\"3891\">no es un derecho consolidado<\/strong> si sigue siendo aut\u00f3grafa observada o sin insistencia. En reportes recientes, a\u00fan se se\u00f1alaba que no estaba destrabada.<\/p>\n<h2 data-start=\"1055\" data-end=\"1594\">Nombramiento probresivo 2022<\/h2>\n<p data-start=\"1055\" data-end=\"1594\"><strong data-start=\"1055\" data-end=\"1130\">Ley N.\u00b0 32390 (2025) \u2013 nombramiento excepcional de docentes contratados<\/strong><br data-start=\"1130\" data-end=\"1133\" \/>Esta norma es de las m\u00e1s \u201cexpuestas\u201d porque el Ejecutivo anunci\u00f3 y present\u00f3 acciones para dejarla sin efecto (por el costo fiscal y por la discusi\u00f3n de \u201ciniciativa de gasto\u201d del Congreso); pero esto depende de la decisi\u00f3n del Tribunal Constitucional<\/p>\n<h3 data-start=\"1055\" data-end=\"1594\">En el video que se comparte revisar
